 Article 1: Processing of personal data

1.1. The possibility of making purchases on the P’tit Po’Pays online store requires the creation of an account on the site www.popays.ch. The member determines a personal username and password. As a result, he is the only one who can access his information, which he can modify at any time by visiting his account.

1.2. The member's delivery address must necessarily be located on the territory of the Swiss Confederation, in French-speaking Switzerland and German-speaking Switzerland. P’tit Po’Pays remains free not to accept a registration depending on its location.

1.3. The member is responsible for the accuracy of the data transmitted to P’tit Po’Pays, which cannot be held liable in the event of errors or inaccuracies, in particular in the wording of the delivery address.

1.4. By registering with P’tit Po’Pays, the member tacitly consents to receive information from P’tit Po’Pays, via various communication channels (e-mail, mail, SMS, telephone). The member can waive it at any time, easily and free of charge, by calling P’tit Po’Pays on 021 544 71 22 or by announcing it by email to info@popays.ch.

1.5. P'tit Po'Pays only transmits personal data to third parties to the extent that they are essential for the proper execution of the order or payment (e.g. transmission of data to PostFinance, to a collection company in the event of non-payment, etc.). The information of its members is treated with confidentiality.

Article 2: Orders

2.1. By accepting the general conditions, the customer accepts that the price of his basket is variable according to the number of packs purchased and therefore will pay the price of his pack each week according to the number of packs he has ordered.

2.2. P’tit Po’Pays delivers to members' homes or work places, depending on their account details.

2.3. All prices given include VAT at current rates. The authentic delivery costs are those indicated when ordering online.

2.4. Orders are delivered in reusable cooler bags as well as glass jars which are exchanged or collected on the next delivery. P'tit Po'Pays and its partners reserve the right to take a deposit and In this regard, Instructions not returned will not be refunded at the end of the collaboration and P'tit Po'Pays reserves the right (if the deposit is not as high as the insulated bags, freezer trays and jars delivered)

to charge CHF 20.00 per insulated bags and freezer trays and CHF 2.50 per jar remaining with the member-

It is in no way the responsibility of p'tit po'pays to recover the jars if the customer no longer places an order. However, on request, P'tit Po'Pays can organize the recovery of the jars for a fee of CHF 7.- which will be deducted from the deposit.

2.5. All orders placed until Friday at 11.59 p.m. are delivered the following week on a fixed day, according to a delivery round. It is not possible to choose a specific delivery time in the given time slot.

2.6. The menus displayed from the Thursday before delivery are authentic.

For all orders placed before Saturday at 11.59pm preceding delivery, the member receives an email confirming the content of his order. The order cannot be canceled or modified.

2.7. The baskets are cancellable due to holidays or other reasons. The member can modify his subscription at the latest 1 week in advance by e-mail, telephone according to the opening hours preceding the delivery date.

Holidays must be announced 1 week in advance. Baskets canceled later are due (orders have already been placed).

2.8. The final interruption of deliveries is possible, respecting a period of 10 days as well as the delivery of a last basket which will allow to recover the boxes and jars. The delivery date of the last basket will be fixed by mutual agreement.

2.9. If a product is not available at the time of delivery, P’tit Po’Pays will try its best to replace it with a similar item. If this is not possible, it is not billed or automatically sent later.

In the event of an anomaly in the order (difference in quantity, product or P’tit Po’Pays within a maximum period of 36 hours for rectification accordingly.)

Products ordered in error are neither taken back nor reimbursed by P’tit Po’Pays.

2.10. P’tit Po’Pays reserves the right to limit the purchase quantities of certain products.

2.11. Meal

Meals are packaged in individual jars (consigned) and closed under vacuum, resistant to reheating in a microwave oven.

For reasons of hygiene and food safety, the meal must be kept in the refrigerator and consumed no later than the expiry date indicated on the jar. For these same reasons, the meal will be delivered to the beneficiary's address and cannot, in any case, be kept outside.

For reasons of food safety and hygiene, open products should not be kept for more than 24 hours in the refrigerator.

Special diets (e.g. no pork, no fish, no cow's milk, etc.) can be covered after agreement between the two parties and must be mentioned when ordering.

  

Article 3: Payments

3.1. The Customer acknowledges having to pay the full price and charges relating to the product purchased, including taxes.

Secure online payment by credit card is made through Stripe. The information transmitted is encrypted by software in the state of the art and cannot be read during transport over the network. Any warranty as to the security of this system is entirely the responsibility of Stripe and cannot be attributed to us.

The prices in force (per week) of the offers from 4 packs are those displayed on the site on the day of registration of the subscription, P'tit Po'Pays reserving the right to modify them at any time. They are indicated in CHF including taxes.

From 4 packs ordered at a time, the purchase is considered a subscription and is payable in CHF. The Customer is solely responsible for the effective payment of the product purchased. The Site uses the Stripe payment service (for credit card payments) and the invoice payment service of P'tit Po'Pays and cannot be held responsible for payment problems related to the operation of Stripe services.

In the event of rejection of the direct debit, P'tit Po'Pays reserves the right to request payment of the amount due by any other means of payment. In the absence of effective settlement within a maximum of fifteen days from its subscription, Popays.ch will be able to automatically terminate the subscription, without prejudice to its right and to request the settlement of its claim for the period passed.

Credit card payment by secure payment server via Stripe is available. By using this service, the Establishment accepts the Stripe conditions of use presented here: https://stripe.com/fr/legal. As part of an automatic payment by bank card, it is up to the Customer whose validity period of the bank card has expired to contact Customer Service and provide the valid bank card details. Otherwise, the subscription will be suspended.

Payment is due immediately on the date of the order, including for subscription products. You can pay by invoice and by credit card (Stripe).

Article 4: Deliveries

4.1. In order to rationalize its trips, P’tit Po’Pays determines a delivery / withdrawal schedule - weekly recurrence - based on the member's delivery address or the distribution point he has chosen. P’tit Po’Pays informs the member accordingly shortly after his registration and, unless specifically notified, this schedule remains assigned to him on a weekly basis for any order.

4.2. Withdrawals are generally made on weekdays, either in the morning (between 8:30 a.m. and 2 p.m.) or in the afternoon (between 4 p.m. and 8 p.m.). It is not possible to choose a specific withdrawal time in the given time slot.

4.3. It may happen that delivery is scheduled for a public holiday. In this case, P’tit Po’Pays reserves the right to change or not the delivery day. This change will be communicated by email.

4.4. In case of absence, P'tit Po'Pays leaves the order in front of the door unless the member indicates otherwise in the "Notes for the deliveryman" field of his account, where the member can specifically request delivery of his purchases either from a neighbor living in the same building, if he indicates the necessary information in this regard, or in a designated place (garage, cellar, terrace, ski room, etc.) at his address delivery.

P’tit Po’Pays must be able to leave the basket in the shade and protect it from frost, depending on the season. This results from the customer's responsibility.

4.5. P’tit Po’Pays undertakes to deliver invoiced purchases and to respect the cold chain until the delivery of the order to the member's address or to the distribution point he has chosen. From that moment, the responsibility for the goods delivered lies with the member alone, regardless of his presence, or absence, during delivery.

4.6. All subscriptions ordered through P’tit Po’Pays partners are subject to the terms and conditions of said partners.

 

Article 5: Right of withdrawal

The consumer has a period of 7 working days to return the non-perishable foodstuffs at his expense, the products not being suitable for him. This period runs from the day of delivery of the consumer's order. Only products returned as a whole, in their original packaging complete and intact, and in perfect condition for resale will be accepted. Any perishable product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged. This right of withdrawal is exercised without penalty, with the exception of return costs. In the event of the exercise of the right of withdrawal, the consumer has the choice to request either the reimbursement of the sums paid, or the exchange of the product. In the case of an exchange, the reshipment will be at the expense of the consumer.

Article 6: The commitments of the parties

6.1. Material organization.

P’tit Po’Pays cannot be held liable for damage caused by the defect of the refrigerator. Likewise, P’tit Po’Pays cannot be held liable in the event of the beneficiary's non-compliance with the hygiene rules and the consumption deadlines indicated on the packaging.

6.2. Quality monitoring

The quality monitoring will be carried out with the beneficiary of the service in the form of telephone surveys or satisfaction questionnaires.

The service undertakes to respond to all complaints made by the daycare. Complaints made in writing are subject to a systematic response by letter sent within 15 days of receipt of the complaint.

Article 7: Civil Liability

Any damage caused to the client as well as to third parties by the delivery person during the delivery of meals is the sole responsibility of the company that made the delivery.

The responsibility of P’tit Po’Pays cannot be sought for damage caused during delivery.

The customer remains responsible for the storage and consumption conditions of the foodstuffs delivered.

Article 8: Force majeure

8.1. Force majeure means declared or undeclared war events, general work strike, epidemic diseases, quarantine, fire, exceptional floods, accidents or other events beyond the control of the two parts. Neither party will be held responsible for the delay observed due to force majeure events.

In the event of force majeure, noted by one of the parties, the latter must inform the other party in writing as soon as possible in writing. The other party will have ten days to find out.

The delivery times will be automatically shifted depending on the duration of the force majeure.

Article 9: Legal information

9.1. P’tit Po’Pays cannot guarantee the accuracy, precision or completeness of the information made available on this site; The photos are not contractual.

9.2. In case of disagreement or dispute, the member agrees to collaborate in mediation before initiating any legal proceedings.

9.3. The place of jurisdiction of P’tit Po’Pays is located in Lausanne and, subject to recourse to the federal court, only the courts of Lausanne are competent to settle disputes arising from the interpretation and / or execution of these conditions.

9.4 All subscriptions and baskets ordered via P’tit Po’Pays partners are subject to the general conditions of said partners.
